VivoNex warrants to the original purchaser of this NexDose® that, should it prove defective by reason of improper workmanship and/or material:

For one year from the date of the original purchase at retail, VivoNex will repair or replace, at VivoNex’s option, any defective part without charge for the part. Parts used for replacement are warranted for the remainder of the original warranty period.

One year from the date of the original purchase at retail, VivoNex will provide the labor for a warranty repair without charge when purchaser delivers the product to an authorized NexDose® service center. Please detach and return the Owner Registration Card or register online within 30 days of purchase so that VivoNex can contact you should a question of safety arise which could affect you.

TO OBTAIN WARRANTY SERVICE, purchaser must mail the product to the nearest authorized NexDose® service center. Shipping expenses are the purchaser's responsibility. Please include the NexDose® request for repair with your shipment. The name and address of the nearest service center can be obtained from a NexDose® dealer, or by calling or writing VivoNex at the toll-free number and address provided below. Proof of purchase is required when requesting warranty service. Purchaser must present the sales receipt or other document that establishes proof of purchase at the time the product is delivered to the authorized NexDose® service center for repair.

THIS LIMITED WARRANTY DOES NOT COVER defects caused by: modification, alteration, repair or service of the enclosed product by anyone other than an authorized NexDose® service center; physical abuse to, or misuse of, the product or operation thereof in a manner contrary to the accompanying instructions; shipment of the product to a NexDose® dealer or service center for service; exposure to excess moisture, dampness, excess heat, fire, flame, or excess dirt and dust; or collision. THIS LIMITED WARRANTY does not cover batteries or damage resulting from batteries; defects in appearance, case parts, decorative parts, or structural items and other non-operative parts.

If you submit your NexDose® for repair and it is determined that the damage is not covered by this limited warranty, you will be contacted and given an estimate for repair. At your option, the unit will be returned or repaired at your expense. You will be required to pre-pay the costs and expenses for repairs not covered by this limited warranty.

THE FOREGOING EXPRESS WARRANTIES CONTAINED IN THIS SECTION ARE THE ONLY WARRANTIES MADE BY VIVONEX. ANY REMEDY FOR BREACH OF CONTRACT WHICH BUT FOR THIS PROVISION MIGHT ARISE BY IMPLICATION OR OPERATION OF LAW, IS HEREBY EXCLUDED AND DISCLAIMED. THE IMPLIED WARRANTIES OF MERCHANTIBILITY AND OF FITNESS FOR ANY PARTICULAR PURPOSE ARE EXPRESSLY LIMITED TO A TERM OF ONE YEAR. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

UNDER NO CIRCUMSTANCES SHALL VIVONEX BE LIABLE TO PURCHASER OR ANY OTHER PERSON FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER ARISING OUT OF BREACH OF WARRANTY, BREACH OF CONTRACT, OR OTHERWISE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
